As we reported previously, Haley is headed to Washington, D.C. on Wednesday (September 2) to give an address at the National Press Club.

Here’s an interesting excerpt from the group’s promotional page for the event …

To submit a question in advance, put HALEY in the subject line and email to president@press.org before 10 a.m. on the day of the luncheon.

Wow.  We can only imagine what sort of questions our notoriously ribald commenters might send for Her Excellency …

Of course since our founding editor already knows the answers to all (and we mean ALL) of “those” questions, he kept his question issues-based.

Here are my questions. Were your parents citizens when you were born? Why should we allow the children of foreigners to be citizens just because they happened to be born here? When the 14th amendment was enacted wasn’t it clear to everyone it would not apply to the children of “foreigners”?. Are you an anchor baby?

No definition??? Actually, the 14th Amendment either confers birthright citizenship or it does not. If it does not, then we have a lot to discuss. Using the so called “subject to the jurisdiction” argument against birthright citizenship is way more complicated than it looks..

To lawyers, subject to the jurisdiction means nothing more than you can be arrested for crimes, tried in our courts for those crimes, and you can be sued in our courts. But with the exception of diplomats living in embassies with diplomatic immunity that is everyone within the borders of the country, so that does not help much. For those who want that to mean more, the most logical answer is at least one parent must be a citizen at the time the child is born. Just being in the country legally as the touchstone really makes no logical sense; because that would include people here on a tourist visa, people on a temporary student visa; or people just here on a short term business trip. Like the English couple who were here on vacation when she went into premature labor and had the child in New York.

Governor (Excuse me Queen Namrata):
After two years how come the people or group has not been brought to justice who hacked the SCDOR and why have you not given us regular reports of the progress of the lame excuse called an investigation or has the matter been swept under the rug and as it seems considered a closed matter?

What was the immigration status of your parents when you were born in SC?

You can combat contractors hiring illegal aliens as independent contractors this way. Report them to the IRS. You can earn a sizable reward for doing so. SEE http://www.irs.gov

Many businesses have attempted to classify workers as independent contractors when they were, in fact, employees. Many businesses have been put out of business by the Internal Revenue Service for doing so. If you make this misclassification and the IRS audits you, they will perform the reclass to employee and recalculate the taxes you should have withheld, calculate interest and penalties, possibly hit you and any other responsible party with the 100 percent penalty, and bill you for all of the above. It won’t matter if the contractor paid the taxes or not. If they did, you will have to find them and prove that they did in order to receive credit for taxes they paid. The IRS will assume that the contractor/employees paid none of their taxes. The end result of such a reclassification is usually more than a business can bear and you can expect absolutely no mercy!

You may also run into similar problems if the contractor is hurt on your premises and wants to collect workmen’s compensation or if he gets sued for damages and either doesn’t have his own liability insurance or is underinsured. I think you get the picture. It can get plenty ugly!

The IRS has developed a list of 20 factors it uses to test employee or subcontractor status. The Department of Labor and state boards will normally follow these as well. Here are the twenty factors you should be aware of before deciding to call an employee an independent contractor.

Should SC school districts, colleges, universities, who received state/federal educational funds be sanctioned for using and allowing contractors they do business with who use/hire/employ/contract with – illegal aliens to construct and/or renovate public schools, colleges and universities? Should they be sued under the Federal RICO Act?
