That was a text message we received this week from one of our State House sources.

Who is Kristin O’Hara? Glad you asked … because we had to ask, too.  O’Hara is probably best known in South Carolina political circles by her former married name, Kristin “Gig” Pearson.  In fact while married to Tim Pearson – a top political advisor to S.C. governor Nikki Haley – O’Hara got a sweet state contract from the S.C. Department of Parks, Recreation and Tourism (SCPRT) worth a cool $50,000 a year.

In 2013, though, she divorced Pearson …

Why does that matter?

Well, the Pearsons’ divorce case (a.k.a. Richland County docket #12DR0448) was sealed … something which almost never happens in South Carolina.

From our story …

Sealing divorce files in South Carolina is incredibly difficult.  In fact one family court attorney told us the process has “gotten a lot stricter recently.”  Like everything in this backward, backwoods banana republic, it’s all “who you know.”

But as it relates to the sealing of this particular file, the “how” isn’t nearly as interesting to us as the “why?”

Seriously … what’s in this file that must be kept under lock and key?

We know Haley is the “other woman” in one divorce case … was she named in this one, too?

Haley vowed to run the “most transparent administration” in South Carolina history … and she still claims to be, despite a litany of examples of anti-transparent behavior.

As a candidate in 2010 Haley invoked a legislative exemption to keep her taxpayer-funded emails, computer records and public phone records hidden from public view after she was accused of having two extramarital affairs.

She still hasn’t released any of that information, by the way …

We reached out to O’Hara’s attorney last October in an effort to determine why these public records are being kept private – but got no reply.

We also reached out to the judge who sealed the file – reportedly under duress – but got no reply.

Tim Pearson was the manager of Haley’s 2010 and 2014 gubernatorial campaigns as well as her former chief-of-staff.  For the last five-and-a-half years, he and Haley have been virtually inseparable – with Pearson managing everything from the governor’s cell phone to her most sensitive scandals.  In fact during the 2010 race Pearson played a starring role in covering up at least one of Haley’s affairs – although to his credit he did express regret over the scorched earth strategy that Haley (successfully) employed in responding to the claims.

According to a source close to O’Hara, there is nothing to the rumor that Pearson and Haley were (are?) romantically involved.

“He was too focused on his job,” the source said. “That’s why they split up.”

Okay … but if that’s the case, why seal the file?

Hmmm ….

Who cares why its sealed, or isn’t sealed. Aside from the people getting divorced, is it really anyone else’s business why they are? Why should you or anyone else have any right to this information?

Privacy in 2014…nonexistent.

Excellent post.I never knew Family Court records were subject to FOIA? I would sue any government agency that released my records to the public and any agency that published them.

If it relates to the behavior or integrity of an elected official, then it has a degree of importance to the public. Perhaps we should seal ALL court records? After all, WHY would YOU need to know the details of a crime that dodn’t involve you directly?

In determining whether to approve the filing of the settlement documents, in whole or in part, under seal, the court shall consider:

(1) the public or professional significance of the lawsuit;

(2) the perceived harm to the parties from disclosure:

(3) why alternatives other than sealing the documents are not available to protect legitimate private interests as identified by this Rule; and,

(4) why the public interest, including, but not limited to, the public health and safety, is best served by sealing the documents.

In family court matters, the judge shall also consider whether the settlement: 1) contains material which may expose private financial matters which could adversely affect the parties; and/or 2) relates to sensitive custody issues, and shall specifically balance the special interests of the child or children involved in the family court matter.

Seems pretty simple.

For custody matters, that is definitely those who are getting divorced; past that–I can’t see a reason why Fits, you, or me need to know anything about why they got divorced. Salacious as it may be, its not your business.

Pretty sure if you were involved in a court case that was sealed, there is likely some penalty for divulging information about it. Chasing dead leads, really.

Will, Kristin’s engagement doesn’t matter. It just gives you an excuse to take a shot at Tim Pearson and the Governor at the expense of someone who doesn’t live in this state and is not involved in your obsession/vendetta. There’s nothing in this story not “reported” previously. You want to write ad nauseum about the improper sealing of the divorce, do it, but why do it at the expense of the person who has done their best to get out of the bad situation, including selling her house and moving out of town?
