JEAN TOAL ISSUES CONFLICTING ORDERS REGARDING LOCAL OFFICIAL

|| By FITSNEWS || A pair of bizarre orders were issued by outgoing S.C. Supreme Court chief justice Jean Toal involving a Richland County, S.C. master-in-equity.

Here’s the text of the first order, released last week …

Pursuant to the provisions of S. C. CONST. Art. V, § 4

IT IS ORDERED that effective 12:01 a.m., August 12, 2015, Joseph M. Strickland is hereby appointed to fulfill the duties of the Richland County Master-in-Equity as interim Master-in-Equity, to so serve until another duly appointed Master-in-Equity assumes the duties of that office, or until further Order of this Court, whichever shall first occur.  This vacancy is due to the resignation of the Honorable Joseph M. Strickland on August 11, 2015.

As interim Master-in-Equity, Joseph M. Strickland shall have all rights, powers, duties responsibilities and judicial immunity of Masters-in-Equity pursuant to the laws of South Carolina.

This order is effective nunc pro tunc August 12, 2015.

So wait … the dude resigned, and then Toal appointed him to the same position on an interim basis?

Now here’s the text of the second order, released this week …

Pursuant to the provisions of S. C. CONST. Art. V, § 4

The Honorable Joseph M. Strickland was appointed to fulfill the duties of the Richland County Master-in-Equity as interim Master-in-Equity, to so serve until another duly appointed Master-in-Equity assumes the duties of that office, or until further Order of this Court, whichever shall first occur. This interim appointment was due to the purported resignation from Richland County of the Honorable Joseph M. Strickland on August 11, 2015. Upon further review, Judge Strickland’s resignation to Richland County was ineffective and there is no vacancy in the Richland County Master-in-Equity office. Therefore, my order of August 12, 2015 is hereby rescinded.

IT IS SO ORDERED.

Jeez.  Now we’re even more confused.

Ordinarily we’d ask “is someone drunk?”  But given Toal’s history that would be too easy …

Strickland has suffered from severe mental illness for decades. He was appointed to be the Master in Equity as a favor to Claude Scarborough and Ed Mullins to get him out of Nelson Mullins when he was found wandering Sumter Street talking to imaginary people. He has issued a number of bat shit crazy opinions through the years when administrative judges used to let him hear occasional “real” cases. He is chronically being reported to Toal’s Office of Disciplinary Counsel for various grievances – and Toal routinely dismisses the complaints to keep Strickland under her thumb. One would call him corrupt, but that would indicate he has good sense – which he has repeatedly shown he does not. The sooner South Carolina gets rid of Toal and Strickland, the better.

At the height of a political corruption trial, the prosecuting attorney attacked a witness.
“Isn’t it true,” he bellowed, “that you accepted five thousand dollars to compromise this case?”

The witness stared out the window, as though he hadn’t heard the question.

“Isn’t it true that you accepted five thousand dollars to compromise this case?” the lawyer repeated.

The witness still did not respond.

Finally, the judge leaned over and said, “Sir, please answer the question.”

“Oh,” the startled witness said, “I thought he was talking to you.”

He was sitting out there trying to make decisions – that’s a joke – he was talking with his imaginary friends. Out loud. This is no secret. I remember old Judge Howell having to call the ambulance and have him hauled off at least one time. There were lost files, missing files, innumerable charges of ex parte communications and on and on and on in Strickland’s office. He had a sexual harassment case filed against him. All of that was okay with Toal, James Smith, John Courson and the rest of them who kept appointing him. Pitiful situation.

It was a hot summer day, and the old courthouse was just as hot. The air was thick and humid, and the jury was having a hard time staying focused. One of the jurors succumbed to the heat, falling asleep just as the victim was being questioned by the prosecutor.

“The defendant is accused of making obscene phone calls to your home. Would you please tell the jury precisely what the defendant said when he called you,” asked the prosecutor.

“I can’t do that,” the victim replied. “It was so crude and disgusting. I can’t use language like that.”

“Would it help to just write it down?”

The victim wrote out every detail of what the obscene caller had said, and passed the note to the judge. The judge read the note. It was then passed to the prosecutor, the defense attorney, and finally to the jury.

The sleeping juror was seated at the back corner of the jury box, and was the last to receive the note. He was awoken with a nudge from an attractive young juror, seated next to him, and she passed him the note. He read it, gazed in awe at the woman, and read it again. He turned to her, smiling broadly, and winked. He then put the note into his pocket.

The judge demanded, “Please pass that note to the bailiff.”

“But your honor,” the juror protested, “It’s a private matter.”

Then there was the nymphomaniac who got herself arrested so she could be tried by the jury.

Her lawyer was doing his best with the jury, as he was telling the twelve men who sat in judgment about her amorous personality, and explained in detail how often and in which ways she performed her sexual exploits, “Shall we find this lovely, long-legged, busty blonde guilty and keep her from returning to her expensive condo, telephone number 555-3267?”

The jury came in with a verdict. She was to have an ‘A’ tattooed on her in a discreet spot.

The judge was curious, “Why an ‘A’?

The jury foreman said, “Because that’s the highest grade we give!”

You know what’s an interesting sound? When the garbage truck rolls down Toal’s street, picks up her trash. When they empty the container into the truck, the sound of many empty glass bottles is heard hitting against one another. Just ask her neighbors who have witnessed it. They will tell you … *smiles*

Old RC lawyer is spot on, Joe has been a nut job for years and the garbage mouth Jean has kept him around for years. It would appear she didn’t check out his so called resignation it is called due diligence.
