COURT RULES CHRISTIAN BAKER MUST MAKE “GAY CAKE”

|| By FITSNEWS || The Colorado Court of Appeals has ruled that a bakery in suburban Denver must bake wedding cakes for gay couples … even if it violates the owner’s religious convictions.

The ruling upheld a December 2013 verdict against the baker – Jack Phillips – who refused to bake a cake for gay couple David Mullins and Charlie Craig, who were married in Massachusetts but moved to Colorado.

According to that ruling, Phillips violated a Colorado statute banning discrimination at “public accommodations” based on sexual orientation.

Mullins and Craig claimed that Phillips’ refusal left them “mortified and dehumanized.”

Sheesh …

We wrote on this case back in 2013, referring to it as “ridiculous.”  And it is.

“Phillips is absolutely within his right not to bake a cake for Mullins and Craig,” we wrote.  “It’s the job of the marketplace to hold him accountable for decisions like that, not the job of government.”

More recently, we’ve written on the debate over dueling liberties in America – and where to draw the line between religious freedom and a legitimate case of discrimination involving essential services.

Obviously government should never discriminate in performing any of its prescribed functions (just as it should never ban or sanction any form of marriage – gay, straight or plural), but what about the private sector?

We believe circumstantial discernment must be applied – i.e. a fair weighing of the competing liberties.

Here’s an excerpt from our post back in April …

Obviously a hospital emergency room isn’t the same as a florist … just as a dentist’s office is different that a restaurant.  Heating and air repairmen aren’t the same as utilities which power their machines.  And attorneys and used car salesman are … okay, there are some similarities there, we’ll grant you.

Bottom line? Each transaction has to be assessed based on the competing rights at stake – which puts added pressure on our judiciary to be fairer (i.e. blinder) than ever.

In the case of a wedding cake, we would humbly submit the baker’s right not to provide the cake trumps the right of the couple to force him to bake it.

Again, such discrimination on the part of the baker is – in our opinion – sanctimonious and wrong, but that doesn’t mean it should be illegal.  Tolerance – like discrimination – is a two-way street.

I did make the Piss Christ reference and I am generally familiar with Serrano’s work, I just don’t think it’s that great. I wasn’t offended by the whole Piss Christ flap; my only point was that picking on Christians and their culture, iconography, etc. is okie dokie. A Klan ref is a Klan ref. I do like being called a “kid,” though. You must *really* old… ;-)

If our founding fathers only knew that our courts would eventually be clogged with such trivial cases. I imagine it will go to SCOTUS. Nine of the brightest minds in our nation sitting in the highest court in the land discussing cakes and thousands of bakers awaiting their decision.

Yeah.I’ve been best man at three weddings(straight),and will do anything to get out of going.There was one where I did the wedding rehearsal,and rehearsal reception.The heavy appetizers were good,and were the only reason to follow through with the real wedding.Italians.What can I say?

If they ask for that on their cake, sure. If not, no.

All the baker has to do is make reasonable accommodations. All a homophobic baker has to do is make a simple wedding cake they would normally sell to a regular straight couple. All a racist baker has to do is make a simple wedding cake they would normally sell to a white couple. This really is not difficult. If they are open to the public, they must serve the public equally.

If the only wedding cake a baker made had a man and woman in icing, they would not be in business long because most straight couples wouldn’t even want that on their cake.

In today’s world they would face public scrutiny and be put out of business by a community that refused to business with racists. I don’t think the government has a right to force a private business to anything. They also don’t have the right to force a private business to do business with anyone. How does the government justify allowing a private business to deny a CWP holder his Constitutional Right to bear arms at their business by saying that the business owner has the right to limit activity on their property and refuse admission or service to people that are armed but then say they do not have the same rights when doing business with a homosexual couple. The gay couples right to a “pursuit of happiness” should not be allowed to infringe upon the business owners ‘freedom of religion.”

There are legitimate religious issues with the refusal to accept homosexuality. Homosexuality is a either a choice or a taught practice from a young age. Race is not a choice. To force someone to alter their religious beliefs to accommodate someone’s choice of lifestyle in their pursuit of happiness is unconstitutional.

Indentured servitude, the13th amendment, is what we are up against. No baker can legally refuse their services because someone is gay nor can they refuse to sell a pre-made cake on the basis that it MAY be used for this or that specific occasion/purpose. They absolutely cannot, however, be forced to make a cake (or anything else) that hasn’t already been made if they do not want to participate in whatever occasion it will be used for. That is the 13th amendment indentured servitude violation. The reason for not being forced into indentured servitude is irrelevant. Religion is the bogeyman in all of this, but it’s irrelevant. There is no “dual liberties” conversation to be had here.
