U.S. Senator Rand Paul of Kentucky is getting desperate …

Wait … hold up: Rand Paul is still running for president?

Yes … yes he is.  We’ve already written his political obituary, yet Paul soldiers on … a shadow of his former self.  A ghost of his once fiercely-held convictions.

How is he doing?  Not well, if you believe the numbers.  Paul is currently polling at 3.5 percent among GOP voters nationally (sixth place), three percent in Iowa (sixth place), four percent in New Hampshire (seventh place) and 3.5 percent in South Carolina (sixth place) – according to the latest aggregate data from Real Clear Politics.

He’s simply not a part of the national conversation … whether it be the debate over the anti-establishment GOP front-runners or the undercard battle between the “Republican” establishment elites.

Desperate to regain some relevancy (and sow some doubt in voters’ minds regarding one of his top rivals), Paul is raising an issue involving one of the GOP frontrunners – U.S. Senator Ted Cruz of Texas.

The issue?  Cruz’s eligibility to be president.

“The thing is, all experts agree that he was naturally born in Canada,” Paul said on CBS’s Face the Nation. “And so the question is – can you be naturally born in Canada and also be considered to be a natural born citizen? It hasn’t been decided.”

Hmmmm …

In August of 2013, Cruz released his Canadian birth certificate – indicating he was born on December 22, 1970 in Calgary, Alberta to a Cuban-born father and an American-born mother.

“Senator Cruz became a U.S. citizen at birth, and he never had to go through a naturalization process after birth to become a U.S. citizen,” a spokesman told The Dallas Morning News at the time.

According to Canada, though, Cruz also enjoys Canadian citizenship.

Confusing, right?  Indeed …

“(The framers) used this unusual language in the Constitution of ‘natural born’, and so I think it will be brought up,” Paul continued.  “Congressman (Alan) Grayson from Florida is already saying he’s going to challenge it in court.  I think the Democrats will challenge it at the very least and I think it will have to be decided by the Supreme Court.”

On that last count, he may be right.  According to Paul, this “extraordinary” situation ought to compel GOP voters “to decide in their own minds” whether this eligibility question matters in picking their presidential nominee.

Cruz has frequently referred to his American citizenship – and by extension his eligibility to be elected president – as “clear and settled.”  In fact that’s the quote he gave CNN in responding to Paul’s statements.

But is it really “clear and settled?”

The U.S. Constitution states that “No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President.”

Does that definition include Cruz?  Possibly.  But if it does … would a judge have to go through the sort of “activist” maneuverings Cruz claims to loathe in order to reach the conclusion that Cruz is eligible?

“(According to) the kind of judge Cruz says he admires and would appoint to the supreme court – an ‘originalist’ who claims to be bound by the historical meaning of the constitution’s terms at the time of their adoption – Cruz wouldn’t be eligible because the legal principles that prevailed in the 1780s and 90s required that someone be born on U.S. soil to be a ‘natural born’ citizen,” Harvard law school professor and Constitutional scholar Laurence Tribe wrote in an email published by The (U.K.) Guardian.

“Even having two US parents wouldn’t suffice for a genuine originalist,” Tribe added.  “And having just an American mother, as Cruz did, would clearly have been insufficient at a time that made patrilineal descent decisive.”

However, Tribe wrote that according to a “living constitutionalist” – a judge who believes “that the constitution’s meaning evolves with the needs of the time” – Cruz would be eligible to run.

“There is no single, settled answer,” Tribe concluded.  “And our supreme court has never addressed the issue.”

Cruz trails GOP frontrunner Donald Trump by fifteen points nationally, but enjoys a narrow (three-point) lead over Trump in Iowa and is second place in early-voting South Carolina.

The other “fly in this ointment (is from what I understand/heard..) is that Cruz only gave up his dual citizenship status a few years ago. That in itself is reason to be suspicious of his motives.
if he has such a hard-on for being a expert on constitutional law why did he not renounce it when he turned 21 instead of waiting till he is a middle aged man????
Looks to me like he wanted the best of two worlds. If he still had dual citizenship when he became a US Senator the fucker should have never been allowed to be sworn in as a United States Senator. I seriously doubt Cruz’ loyalty to this country.
And as you know, McCain was born in the Canal Zone (a US territory at the time where all males 18 years & older were subject to the draft) in a United States military hospital and both his parents were US citizens . I never had a problem with that whatsoever but I do remember it being made an issue (although short lived)
The fact is Cruz was born in Canada (not on a US military base) with only one parent being a US citizen.
Since many of Cruz’ and that lying SOB Trump’s followers are making a case to not allow some wetback mother drop a kid inside of the United States border to be a US citizen the minute they are birthed they need to quit their hypocritical BS and apply the same standard to Cruz.
But you and I both know they won’t

Hillary will not likely see any day in court and if by some remote chance she does she will be pardoned by Obama before the gavel falls to start the trial of the day.

Just the framing of the article “canadian birther gaining traction” is laughable for the simple fact that he was factually birthed in Canada so one would naturally assume that it would gain traction since it directly contradicts the Constitution’s Natural Born Clause.

Same goes with the framing of the article “Rand Paul’s desperation meet Ted CRuz’s eligibility” when in fact we know Rand is a Constitutionlist who take the Constitution seriously and probably understands it better than the supreme court judges. A better framing of the article would have been

Rand Paul Supreme Understanding of the Constitution meets Ted Cruz’s in ineligibility.

That would be the (bland) Rand that is sitting out the Charleston Debates cause he’s only eligible for the kiddie table at one and not party line enough for the Saturday debate?
