FREE SPEECH? OR CREDIBLE THREAT …
|| By FITSNEWS || An Atlanta woman was arrested this week after she went on social media and called for blacks to “rise up and shoot at every white cop in the nation starting NOW.”
Ebony Monique Dickens – who goes by the name Tiffany Milan on Facebook – was charged with the dissemination of information related to terroristic threats.
“I condone black on white killings. Hell they condone crimes against us,” Dickens said in her message. “I’ve thought about shooting every white cop I see in the head until I’m either caught by the police or killed by them. Ha!!!! I think I can pull it off. Might kill at least fifteen tomorrow. I’m plotting now.”
“They reading this sh*t too right now,” she continued. “Freedom of speech tho. So when you can absolutely show me the 1st amendment where it explicitly says you can’t say “kill all cops,” then I’ll delete my status. Other than that…NOPE!”
“Death to all white cops nationwide,” Dickens concluded.
Wait … doesn’t Dickens have a point? Not about killing cops, obviously, but about freedom of speech? Doesn’t the First Amendment grant her the right to say pretty much whatever she wants … even if it is encouraging others to commit murder?
We certainly believe so …
Of course Dickens took things one step further than that. Not only did she say blacks should rise up and kill “all white cops nationwide,” she specifically said she was “plotting” to kill police officers herself – even citing a specific number of officers that she wanted to kill. Not only that, she indicated her contemplated killing spree was imminent.
Were her threats credible? We doubt it. Was she really “plotting” to shoot police? Again, probably not. Nonetheless, her Facebook post contained precisely the sort of language police need to convince a judge to issue a warrant.

This website will always defend free speech and reject efforts by government to intrude upon it – even if the speech in question encourages violence or ultimately incites violence. Such contributions to the marketplace of ideas may be contemptible (and may lead to terrible things) … but they are nonetheless part of the marketplace of ideas.
And they cannot be criminalized.
However, speech which refers to an individual’s imminent intention to deprive another human being (or beings) of their most fundamental liberty – their life – is not free speech, it is a criminal act.
We suspect police will discover Dickens was merely blowing off steam with her post – that she wasn’t actually “plotting” the imminent death of fifteen police officers. In that case, the charge against her should be dropped and she should be permitted to return home with a clearer understanding of the boundaries of this particular envelope.

Ignorance is bliss. Freedom of speech does not a person to say anything they wish to at any point they wish. Freedom of speech is the right to voice your concerns to the government and be able to speak out without the thought of the government come after you. Freedom of speech doesn’t give a person the right to use profane language or make threats or harass people.
Even if she is innocent, there’s no protection against being arrested. They can arrest you if they think there might be some charge somewhere, and hold you for 24 hours while they talk to the DA about it.
You have to change *that* before you can start on “freedom of speech” – a specific case has to be brought before the supreme court that has these particulars in it, and have them rule that you can’t be arrested for it, before you can be sure you can say it without being arrested.
If they’re not sure, they can arrest you.
That’s the law… you libertarians need to get busy and get the cases that chap your ass in front of the Supreme court… how else are you going to change the law? Popular opinion?

As is often the case, your version of reality doesn’t *precisely* mesh with the actual world. Cops most certainly can not pick folks up willy-nilly “if they think there might be some charge somewhere.” The Constitution (and all 50 state Constitutions, by the way) require probable cause for an arrest. Period. You may be thinking about some of the stranger warrants (like federal material witness warrants), but at any rate the system is not as you describe it (thankfully for all of us).
Probable cause for an IQ of 50 is waggling bushy eyebrows, or holding a camera too close.
They can always dismiss the charges, or not press charges at all. That happens *all* the fucking time.

I have no idea what you’re talking about, but PC has to be approved by a judge, and does not include anything related to eyebrows. PC is an intentionally low standard (much lower than the “proof beyond a reasonable doubt” threshold), but it is a fairly well defined standard. What happens “all the time” is that everyone arrested on-view for felony (without a warrant) gets their 10 minutes of hug time in front of a judge within 24 hours (usually with 2-6 hours) and in almost every case probable cause is found and the defendant is bound over or released on bail. Your vision of criminal justice reality is simply not, well, reality.

I am not sure why this story is here, except to stir up the racists that frequent this site. This is one person. She is a nut. There are nuts in all races. There are killers in all races. It means nothing. Do you think there are no white people who talk about killing all the black people?
