By FITSNews || Fifteen-year-old Soo Jin Sung is one of only two eyewitnesses to the fatal collision that took the life of her best friend Mairi-Caite Miller five months ago.
The other witness? That would be Scott Dutton, the car salesman whose SUV struck and killed Miller as she and Soo Jin were walking along the side of Archer’s Lane in Columbia, S.C. on that fateful night in February.
A formal investigation into the incident conducted by the S.C. Department of Public Safety (DPS) concluded that Mairi-Caite – not Dutton – was at fault in the collision because she was walking in the middle of the lane and wearing dark clothing. However, that version of events is being vigorously challenged by Miller’s family and friends – and at this point the evidence appears to be stacking up in their favor.
In an exclusive interview with FITS earlier this week, Soo Jin made her first public comments about the incident – telling FITS that the official DPS report of the accident is inaccurate on multiple counts.
Soo Jin says that she and Mairi-Caite were walking on the side of the road – several feet away from where they are recorded as having been walking in the official DPS incident report. Soo Jin says she remembers the location precisely because Mairi-Caite had been walking in the roadway moments before the collision but then a car horn caused her to jump back to the curbside.
“Right before (the accident) a car came by and honked at us,” Soo Jin says. “It startled her and she hugged up against me. She was right up against me after that.”
FITS accompanied Soo Jin and Mairi-Caite’s mother, Nicole, to the scene of the accident on Monday. There, Soo Jin (wearing the blue shirt) showed us exactly where she and Mairi-Caite were standing at the time of the collision (Mairi-Caite’s mother is standing in her daughter’s place) …

Obviously, that’s a big difference.
Even more disturbing, Soo Jin says that on the night of the accident, the Highway Patrolman who was leading the investigation attempted to physically position her further towards the middle of the lane as she was attempting to describe what happened to him.
“He kinda did tug me a little,” Soo Jin says.
Soo Jin says she told officers where she and Mairi-Caite were standing a total of five separate times.
“I was on the grass,” she says. “She was right next to me. I told them that. The only thing I’m absolutely sure about is where we were.”
Soo Jin also told FITS that she will testify to what she witnessed in court, if necessary.
Mairi-Caite’s case attracted our attention two weeks ago when we were shown a Highway Patrol dash-cam video of the aftermath of the accident.
In that video, Dutton – the driver of the SUV – admitted to the S.C. Highway Patrol officer investigating the crash that he had recently taken the powerful painkiller Hydrocodone, which is a widely-abused prescription medication. In spite of this admission, Dutton was never given a field sobriety test – even though his speech sounds slurred at several points during the video.
Dutton was allowed to leave the scene of the fatal collision that night after scrawling his barely-legible signature on a gramatically-incorrect one sentence statement – “I was driving along and I did not the girl.” Presumably, the statement was supposed to have said that he did not “see” Mairi-Caite.
On the advice of an as-yet-unidentified attorney (originally rumored to be Columbia powerhouse lawyer Jack Swerling), Dutton declined to make any additional comments to police on the night of the incident. Authorities made only one effort to follow up with him (a phone call eleven days after the accident that yielded no answer). Frankly, it’s not surprising that Dutton isn’t talking – and not just because of the Hydrocodone. According to a copy of his 10-year driving record obtained by FITS, the Columbia car salesman has been cited for speeding ten times over the past decade. He was also cited twice for careless or negligent driving over that same time period.
Using the S.C. Freedom of Information Act (FOIA) to collect videos, photographs, official documents and other information related to the incident, Miller’s mother has uncovered numerous discrepancies in the official version of events. Those discrepancies are what has prompted FITS (and apparently several other media outlets) to take a fresh look at her daughter’s death. To his credit, S.C. Department of Public Safety Director Mark Keel is cooperating fully as we delve into his agency’s investigation of this accident. In fact, his office has agreed to conduct a sit-down interview with us to give their side of the story – an interview we hope to conduct next week.

The speeding tickets, in themselves, are not particularly concerning to me. Plenty of people speed & get tickets (sometimes a lot depending upon where they live) but also are safe drivers and only drive fast when it is “safe”. However, the “careless or negligent driving” citations are very telling; very few people get that kind of citation. And combining speed with carelessness & negligence is a VERY dangerous cocktail; particularly if you throw drugs into the mix.
Keep this going FITS. I don’t like to see the “connected” literally getting away with homicide.

Thanks for the update FITS. Clearly there has been a lot of wrong doing and mistakes made regarding this case and I just hope that in the end – the whole truth will come out and the Millers will get the peace they need and the justice they and MC deserve!
For all the bashers out there – whether it be towards Fits or the Millers, can you just please keep your thoughts and comments to yourself? You are not helping in any way! A child has died, there are lots of questions that need to be answered, and there are lots of feeling running raw… can you just be tolerant until the entire truth comes out? If you feel the need to rant and bash people concerning this case, go talk to a mirror. If you have facts that are truthful, then present them to the Millers with your proof – but no need to hurt a family who has lost so much already!

Seriously? You’ve never heard of someone facing some charge or investigation and retaining an attorney to protect their interests regardless of a charge being filed? FITS, the elevator doesn’t appear to be getting to the top floor if this is the best logic you can present.
Also, in your original post you were damn sure Swerling was his lawyer and devoted a whole paragraph to why that was a big fucking deal. Now you backpedal?
You’re becoming irrelevant, you know? I still stop by to see what’s going on and to look at the ladies, but the valuable political scoop that I crave is missing.

I love the way you appear to keep forgetting the witnesses who saw the whole thing and stated to the police, ( not sure which police because there were several different agencies on the scene) that IT WAS NOT MR. DUTTON’S FAULT. These witnesses saw the accident and also spoke to someone else at the scene, so there are others who have heard what they saw. I hope these witnesses won’t be ” convinced” to change their story.
The way I see this, it is looking more increasing clear that you, Fits news, the Millers and their cronies might only be looking for “evidence” that makes Mr. Dutton look bad. Have you guys published anything in his favor?

I am not blaming the girl, but if it would have been me, the horn would have been a warning and I would have gotten up on the grass with her friend, and would not have stayed on the concrete which is part of the roadway.

People close to the case are concerned enough that they let the public know how they are connected to this case. Then there is you….why don’t you tell everyone how you are connected to this case and where you are getting your so called “FACTS” from? I’d surely like to know. It seems that the Millers have several things to back up their allegations, but I haven’t seen you give any hard evidence.
Also, I have to disagree that Soo Jin is not a witness…I’m pretty sure she saw the car who hit her friend, and I’m sure she saw her friend flying through the air. How can you even suggest that she was not a witness?

There really is only one person who knows what happened that night—Mr. Dutton. Where is his voice in all of this? Why has he not come forward to explain what happened? His silence does seem a little telling. Ms. Smith, if you are a friend or relative of his, I understand your defensiveness, but I think putting the blame on a young girl or attacking her family is unnecessary. You keep talking about facts, but the only real fact is that there are a LOT of problems with the way things were handled that night. Whether or not Mr. Dutton was at fault, it is obvious that there was much missed. If the police had questioned him that night or done a field sobriety test or insisted on blood tests that night, no one would be having these arguments now. Questions would have been answered.
I think the Millers just need some answers so they can have some closure in what has to be the worst thing that can happen to a family. Everyone needs to remember that they deserve love and prayers and not hate and vileness at this time.

It seems clear to me that Susan Smith is. . .Scott Dutton. Let’s follow the evidence he presented in the last post. The opening paragraph states that Fits, the Millers and others are “looking” for evidence to make him look bad and he questions why noone has posted anything in his favor. Dutton made himself look bad on the unrefuted dash camera and statement. If he has access to witness statements or accounts from other alleged witnesses, then post them. Otherwise, real proof 1, alleged proof 0. He makes several comments about “says something to me, thanks” and “doesn’t mean much to me”. Someone is taking this very personally. If that’s not enough lets look at the paragraph where he tries to dispute Soo Jin and her ability to witness then shows empathy for her and finishes with “if you only knew. . .” If Soo Jin didn’t see things because she was facing the wrong direction, the only person who has the ability to dispute her statement is the driver in the absence of other witness statements. Saying “if you only knew,” tells me that he is feeling alot of guilt for his actions but can only express this guilt in his childish lashing out at the Millers. If YOU, Scott ,are going to turn to the internet to try to defend yourself, then at least have the courage to identify yourself. Fits, how about doing an IP or email search with your web host to show who this is and let investigators see his attempts to harass the Millers in multiple electronic forums.

As it appears my responses are very much in demand, please accept my apologies if I don’t address you all individually.
I’m not even going to address the ridiculous comment that Soo Jin was ” a witness” to the accident unless she has eyes in the back of the head. According to the statement above, they were warned to get out of the road by someone honking their horn and 1 of the girls made the choice to stay in the road. End of sentence. (A witness to an accident would have seen it happen, not just witness the terrible aftermath.)
AGAIN, I am not blaming either girl for their actions.I just wish someone would have driven them home.
As I have said all along, there are certain things that I know for a fact. And there are witnesses, other than Mr. Dutton, who can back up the statements that I have said are facts.

This is absurdity. Susan Smith, you should Shut Up. You are not helping anyone’s case. Mr. Dutton is obviously going to keep his mouth shut because there is an ongoing investigation in which he could be charged with vehicular manslaughter. Mrs. Miller and her family are obviously going to continue to investigate this case. If it were your child, wouldn’t you?
The only person acting out of insanity in this case are the people defending Mr. Dutton. No one thinks that he hit this child on purpose. On the other hand, when you hit someone WITH YOUR CAR trying to make excuses saying that the person was standing in middle of the road is stupid. I don’t care if she was in the middle of the road. Did the car have headlights? Brakes? A horn? A competent driver???
And furthermore, if the two girls were walking side by side, then obviously Soo Jin is a credible witness. Susan Smith, if someone was walking beside you, and then HIT BY A CAR, would you not have some idea of what happened? Whether you were looking at the car or not, wouldn’t you still hear the car? See someone’s body flying through the air? Notice that the person who was beside you is now NOT beside you?
And so Susan Smith, here is some advice. Do Scott Dutton a favor and shut up. And do the Miller family and friends a favor and show some respect. Your only comment on this case should be, “I’m so sorry for their loss. I believe that the investigation is in competent hands and will be completed with integrity. I hope that the family and friends of this young woman are able to find peace.”

I’m from Maryland & am not familiar with South Carolina traffic laws. I’m guessing that it’s very similar to Maryland’s. Following is a link to some explanations of Maryland traffic laws. Following the link is some language copied from the pdf. If SC’s definition is similar to Maryland’s law, then Mr. Dutton had at least one previous conviction indicating he was “…operating a motor vehicle in a careless or imprudent manner that endangered….the life or person of any individual.” Such behavior & driving habit can be habitual in some people; particularly when they are under the influence of drugs. I have no knowledge of this case but it smell very fishy indeed. For whatever reason it appears that the authorities did not conduct a comprehensive investigation or accident reconstruction at the time of the accident. A girl is dead…she and her family/loved ones deserved to at least have a proper investigation of her death.

PS – Note that in the pictures the accident scene was VERY close to a street light. Wherever the girl was standing, ANY observant driver driving at a reasonable speed & paying appropriate attention should have seen her in plenty of time to brake or otherwise avoid hitting her.

When all is said and done the Miller family have lost their beautiful 15 year-old daughter her life ended way too soon!! Is it unusual for the family to want real answers to what happened to their daughter that night? The driver states he took a narcotic before getting behind the wheel of his car, and he hits and kills a girl that evening! Again is it unusual for the parents to want justice for their daughter?
Let the investigation continue and allow justice to be served, allow the court to decide. Last I heard this is still a democratic country and we have the right to a fair trial for all parties involved.
SHAME ON YOU Susan Smith for attacking a family who simply are looking for answers and justice for their daughter. Do you really need to experience something like this personally to have any empathy for this family?!

I love the way you appear to keep forgetting the witnesses who saw the whole thing and stated to the police, ( not sure which police because there were several different agencies on the scene) that IT WAS NOT MR. DUTTON’S FAULT. These witnesses saw the accident and also spoke to someone else at the scene, so there are others who have heard what they saw. I hope these witnesses won’t be ” convinced” to change their story.
a. If there were all these witnesses—where are their statements?? If they were willing to go on the record—they should have stayed and given their statements to the police. And uh, for your information—people that heard about the crash from others are NOT witnesses—they are just that—people who heard something third hand–HEARSAY—and are therefore worthless. But, be that as it may—the “official” report from the police and the witnesses that are on the MAIT report plainly state that NONE OF THEM actually SAW the crash. They all HEARD it (sounded like an explosion) and saw the girls in silhouette (in dutton’s headlights seconds BEFORE the explosion). But, the people that actually GAVE FORMAL STATEMENTS; on VIDEO; (not incoherent ramblings like: I WAS DRIVING ALONG AND I DID NOT THE GIRL) They state that 1. They did not SEE the actual crash 2. They saw the girls prior to impact (from the curve in the road—approximately 250 feet from the point of impact) at the time they saw the girls (in silhouette from duton’s headlights)—when he was closer—and should have seen them
The way I see this, it is looking more increasing clear that you, Fits news, the Millers and their cronies might only be looking for “evidence” that makes Mr. Dutton look bad. Have you guys published anything in his favor?
a. Why won’t Dutton talk to anyone?? I am sure Fits would be MORE THAN HAPPY to talk to him. If he is so innocent—why did he avoid the police? The “official” witness log states that he REFUSED to be interviewed that night—and would talk to police the following week AFTER he talked to his attorney—when the police called him on February 16, 2010—he NEVER called back. HE HAS NEVER SPOKEN TO POLICE—to this very day!!
b. Where is your PROOF that anything that has been printed is incorrect?? Why can’t you provide the documentation to PROVE YOUR WORDS??? I have read about HEARING DUTTON on VIDEO—SEEING “official” SCHP Documents—Yet—there is still no VERIFIED PROOF FROM YOU OR DUTTON!!! Put up—or SHUT UP!

a. Police and others (associated with Dutton) have given Mr. Swerling’s name as the attorney he called that night. There are only 2 attorneys in Columbia by the name of Jack—one is a Real Estate lawyer—the other—Swerling is a criminal lawyer. I don’t think Dutton was calling about a closing. Figure it out Einstein. But, being responsible, since Mr. Swerling has not yet returned Fits’ calls—he states: an as-yet-un-identified attorney (originally rumored to be Columbia powerhouse lawyer Jack Swerling),But, he STILL states Swerling. Where’s the inconsistency? I see responsibility. He is HEARD saying Jack—Real Estate or Criminal??? He is HEARD admitting to hydrocodone—CRIMINAL. As it appears my responses are very much in demand, please accept my apologies if I don’t address you all individually.
I’m not even going to address the ridiculous comment that Soo Jin was ” a witness” to the accident unless she has eyes in the back of the head. According to the statement above, they were warned to get out of the road by someone honking their horn and 1 of the girls made the choice to stay in the road. End of sentence. (A witness to an accident would have seen it happen, not just witness the terrible aftermath.)

face it- the driver was nodding out driving under the influence of narcotics.
it happens every day. thats not what bothers me the most about this horrific fatality.
no, what bothers me is the SOBER members of Law Enforcement
who did not do the jobs they are paid to do. when a child is laying there dead and the driver admits he is on narcotics, why not give him a field test? is it THAT difficult? is that not part of protect and serve?
especially given this is not the first time SC LE has let drivers leave the scene and not tested them after a fatality!

the only case where the driver was eventually taken in,
was the Ashlyn Sims (who was pregnant) case.
however… it took SCHP over 3 hours to take the underage drunk driver
in for a BAC test, at which time he was no longer over the legal limit.
so he was never charged with a DUI even though he admited to LE he had been drinking allll day.

To Kelli’s Mom, First let me say how sorry I am about your loss — the pain never goes away and things such as these “comments” only serve to keep the wound open — again, my deepest sympaties.
I had no idea that there were so many cases where the police did not do their job propertly.
Unfortunately, many who have written on this site are only here to entertain themselves with their “opinions” and the ability to bash and abuse those who have experienced a horrific loss. They show absolutely no compassion for those who have suffered from this accident — but only want to “have their say”. I feel sorry for them as they obviously do not have much of a life —
Again, please accept my sympathies on your loss — I would like to think Kelli and Mairi Caite have become friends in another world.

Someone needs to explain to me how this site is only supposed to be for one side of an argument. Last I checked everyone is entitled to an opinion. And this isn’t a private forum. Where is it written that only those who agree with every word the Miller’s and their friends say is allowed to write a comment.
I think something is lacking in the SC police treatment of the case and those officers need to be brought to task for being incompetent, but to attack anyone who isn’t 100% compliant with what ever you’re spewing is stupidity. You taunt a person to come on and comment on the situation and then when she does you attack her like a pack of mad dogs. You ridicule people who don’t agree with you for not using their real names, yet none of you (other than the Miller Family) are using your real names. Talk about hypocrisy. And then you wonder why the rest of the country thinks the south is full of low IQ rednecks. This site and these comments are a joke. none of you other than the family want an honest dialog — you want to roll in the mud. you are just as guilty for agitating the family as the people you accuse of doing the same because the bile you are spilling isn’t helping anyone. If you really give a damn about this case and the family, contact your congressmen constantly, contact you senator, contact your governor over and over again until they have to address your concern. Write letters that can be printed in a reputable news paper about this incompetency. Don’t just sit there and rattle a cage and then go back to living your life — DO SOMETHING.

Noreen, Your points are well taken — my daughter has poured her heart out with information taken from the police reports and from eye witnesses’ reports. Her comments are not “opinion”, they are facts that she has pains takenly put together from the police reports, the cornor report, the dash cam videos and long exhaustive conversations with the SCHP.
I, personally, was in her kitchen on two occasions when the police came to discuss aspects of the case — most of our questions (some as simple as where is Mairi Caite’s cell phone) went unanswered with comments such as “we don’t know” or “we don’t have that information”. It took the police over a week to locate Mairi Caite’s cell phone in the back seat of the police car that had been at the scene. It is issues such as these that caused my daughter to begin her search for answers.
So, yes, her information is FACT — and while she does not mind people questioning her facts, it is extremely disturbing for friends and/or family members of Dutton’s to be contradicting everything that she or some other member of our family states — and not to have the decency to at least use either their name or admit to their relationship to him. Especially when the intention of all of these articles and comments are more directed at the sloppy investigation on the part of the SCHP and not directed at Mr. Dutton. Comments about his use of drugs the day of the accident are more to point out WHY the police chose not to do a drug test — it is the police who our family blames — it is their inefficiency that has caused us so much pain because of the lack of information about that night. One of the biggest problems I had was the fact that the police, three and a half hours after my granddaughter was killed, still had not made any attempt to reach my daughter and her husband to notify them of her death — They were told by a member of the media “some kid down there was hit by a car and killed”. When I asked the Leutenant why, the answer was they were in the middle of an intense investigation —- really???
Our family has nothing to hide, that includes our names and our belief in the facts that have been given to us by the police and the witnesses.

Most of these comments are just sickening. I feel for the Miller family but they need some serious counseling. They are trying to point the finger and make anyone pay for their daughter losing her life. Point blank….it was dark, she was wearing dark clothes walking in the roadway. The SCHP is more qualified in wreck investigations than anyone. They did the investigation exactly by the book. There is always going to be someone who is not happy with the outcome. This time it happens to be the Miller Family. Nothing they do and say is going to bring their daughter back. Quit badgering the SCHP and everyone else involved for doing their job!!!!

Mema…..this is a closed case! There are no loose ends! SCHP did a complete investigation along with their MAIT team. (who does nothing BUT investigating) I’m stating the facts here. This family needs to deal with the fact that she’s gone and quit pointing the finger at everyone. They’re upset that no one is to blame but their daughter. If anyone is to be charged it would be her for being in the roadway. It’s made for vehicles not people. If it was my child she wouldn’t have been walking. I would be with her driving her in my car!

Southern Girl….you mention the dash cam in the police car. Yes, there was one and I don’t see where that point is leading to?! Oh and there were witnesses that saw her in the middle of the road. Why would they lie? You’re comparing this to people hitting animals…what an idiot! If it’s so easy just to come to a stop why are there so many dead animals in the road?! This was an ACCIDENT! No one is to blame but the person walking in the middle of the road. It was raining and she was wearing dark clothing. My parents never let me walk on busy roads and commen sense is not to wear dark clothing. The parents need to get counseling on this and quit pointing the finger at everyone. The law enforcement working that night did a thorough investigation went by the book. Seeing a child hit by a car and investigating it is something no one wants to do! It’s their job to do it right and that’s the way it was done! The comment you made about North Carolina…..well, they have the SAME laws we have here! Obviously you’re not too aware of the laws!

I have read all the stories related to this tragic accident and my prayers are with the Miller family. The unfortunate reality is that Miss Miller was walking in the roadway as said by witnesses to the collision. I believe the big question is was the driver under the influence which the SCHP answered and explained. I watched the 2 news stories from WACH and WIS and it appears the SCHP did a thorough investigation. The special team stated it was dark and raining when the accident happen. If Miss Miller was wearing dark clothes while walking in the road with the flow of traffic, that was a bad decision. The portion of the video that was shown where the trooper was talking to the driver sounded like a man emotionally upset to which I could fully understand why. The picture in this article showing where she was walking is clearly in the roadway. The video from WACH where the trooper is explaining the accident and he said witnesses said both girls were in the roadway. One person critized him by saying he wasn’t even there so he is lying. They are probably right but the witnesses were there. I cant understand why one would say such comment. I guess it’s ok to criticize law enforcement but they are hero’s when you need them. I can understand a lot of questions being asked but this accident was investigated and determined Miss Miller was to blame for being in the road. All the comments here are either bashing one or the other. I’m sure no one likes to hear negative comments to what they have said but this blog promotes it. Why is it when someone shows support for our law enforcement they get jumped on with 2 feet bashing them and calling them names? SC has laws that we might not like or like but they are the laws. May the family find peace one day.

I have seen the police discussing the debris field–and how far back it went–I also saw them stating very clearly where Mairi-Caite was standing–RIGHT NEXT TO THE CURB–where Soo-Jin was standing–in clothes so LIGHT they GLOW on the dash-cam–I also heard your dutton say he did not know how fast he was going–how he did not know what he had hit-that he heard an EXPLOSION– andf he was disoriented–and confused–does this sound like a man that was paying attention?? I also saw the weather report–NO RAIN AT THE TIME OF THE CRASH—I also heard your dutton say he took the drug at 8am and again after lunch–at about 2 or so—–so yes Susan/Scott/whoever—I have seen the dash cam–a few of times in the past couple of days–and I have watched the SCHP officer–Lee–wHO WAS NOT THERE–he called the family and had the nerve to tell them he didn’t know the crash–b/c he wasnt there–his other team members were there–so–refresh his memory which one this was–why don’t you come out from behind your names–if you are so sure of your version of events—why don’t you let everyone know who you are??? to SCHP- SOUTHERN REDNECK GIRL AND PROUD OF IT!And not only have I seen the dash cam video, but I have a copy! And yes, NC does have almost the “same freaking laws” but only thing is, we employ them. IF you had read all of the documents that I have, you would know that this “investigation” was not handled correctly. If you were in the Millers’ shoes, wouldn’t you want all questions answered so that you could have some closure?! I guess that all of you SCHP/SCLE supporters thought that Mairi-Caite’s family would just let this investigation ride and take them at their word. But your “boys” screwed up on so many levels….dutton is only questioned for about five minutes that night(and NOT AT ALL since),several times he said he didn’t know/could not remember how fast he was going, his speed was based (by SCHP) on a dry road not wet and at 35mph.. BULLSHIT, MC was not wearing all dark clothing but at any rate the other girl had on light clothes, there were tire marks against the curb where the girls were(which should tell anyone with ANY sense that dutton was hugging the curb)this is a straight stretch of road where two people walking should have been clearly visible drizzle or not(if your vision isn’t impaired by drugs)I could go on and on but MAYBE you get the big picture…..this case may be “closed”to some of you, but not the family and friends of MAIRI-CAITE MILLER!

We are just tired of this going on and on and on when everything that can possibly be done has been done!! The family is not happy with the outcome and it’s very sad but nothing is going to bring her back. How can she and the family rest in peace with all this fighting going on?? Let me also say Dutton is not “my dutton” as you say he is. I have no clue who this man is. I am going by the facts and stating my opinions. Isn’t that what this site is anyway? All the family members come on here bashing everyone and especially people like Susan Smith! She had every right to be on here like everyone else. We all may not like everything she said but that is her right to voice her opinion. In the road, walking by the curb…it’s all in the roadway. When there is a sidewalk 10 ft from the road, it should have been utilized. I also don’t see any report of tire marks on the curb. Must be something new the family is trying to bring up since everything else is being proven the HP are right. I’m also trying to figure out why you go on and on about revealing who makes comments but you’re “Southern Girl.” You’re doing the same as everyone else. Even if everyone gave their name, what’s the big deal? Are you going to hunt them down and stalk them? I am not a member of the SCHP but I have very dear friends who are so I do know the complete facts. I know every law enforcement agency there did their job completely that night. southern girl: At first people supporting the Miller family have stated that there was no sidewalk. Now, there is reference to a sidewalk “10 feet” away from the road.

So , please answer a few simple questions: Why were 15 year old girls allowed to walk in the evening, when it was dark, and very close to a sidewalk where there were “thugs and drugs?”.
Are you pushing all the blame on dutton and the SCHP?
Shouldn’t someone else take responsibility for the fact the girls were walking in a dangerous area to begin with?( without even considering the fact that Soo Jin stated “Mairi-Caite had been walking in the roadway”.)
You just seem to want to cast blame on those you choose, but refuse to accept that
maybe some others need to accept blame for the fact that, on your own accord, they were in a dangerous area.
As sad as this situation is, it’s obvious the girls never should have been there to begin with.
And that is not the fault of the SCHP!

I am shocked that someone would critisize someone for using a ficticious (that means fake) name when you are using one too… I would be happy to share my contact information with you directly so I can share with you the entire accident report.
Mrs Miller is not making this stuff up… Mr. Dutton’s actual written statement that night says “…I DID NOT THE GIRL” All CAPS. So, my simple question since you referred to him several times in this discussion as a witness, is: How can you count him as a witness if by his own admission “Did not the girl?”

So now FITS, who we were promised would be publishing so many facts implicating Scott Dutton that it was going to make all of our heads turn is stating that they’ve viewed the video from the scene and Marie Caite was wearing dark clothing AND they heard the testemony from witnesses stating that the girls were in the road..
Among the key pieces of evidence presented by the department were photos of the accident scene which clearly show Miller wearing dark clothing – which had been the subject of some dispute in the aftermath of the crash. FITS was provided copies of the photos, although we were asked by Keel not to publish or disseminate these photos as they contain graphic content.
Also provided to FITS were audio recordings from a pair of eyewitnesses, who stated that Miller and her friend, Soo-Jin Sung, were walking in the roadway at the time of the collision and that fog and rain had diminished visibility at the time the crash occurred.
It appears the proof has come out indeed and it’s been published by FITS. Oddly Southern Girl hasn’t bothered commenting on that. I wonder why.

Mairi-Caitlin’s family and friends were on my mind on Thursday and several days last week and several weeks ago.
I hope FITS is in his Mensch phase and lets me post this because I tried to post earlier this week and he did not run it.
So, because the South Carolina Chapter of MADD is in disarray, I decided to form DADD (Doctors Against Drunk Driving). And I decided that my first contribution would be in the sentencing of one Richard Wayne Mason, who is the son of a man who actually got away with murder (by a gunshot wound to the head of his second wife 17 years ago) for DUI first, specially that the trooper who arrested him had told me that Richard claimed to be “a private investigator” and no one can do anything to him.
Well, Richard Wayne Mason’s arrest was in February 2009, and his defense kept continuing the case until September 2010. There and then he claimed to have mailed a Rule 5/Brady motion (which was NEVER filed with any court and NEVER followed up on with a motion to compel discovery) but to have never received a response.
The prosecutor said basically nothing other than that Richard’s lawyer is beautiful; and the case was dismissed.
Now, the Constitution is more important than any one case. And I respect the Double Jeopardy Clause too much to even try O.J. Simpson again. BUT THERE ARE SIMPLE THINGS THAT CAN BE DONE.
We can request a judicial directive that no motion to dismiss in DUI or DUS case can be heard based on lack of discovery unless and until two things happen: (1) the motion is actually filed with the court; and (2) if there is no response to it in 30 days the defendant files a motion to compel.
We can also request that any prosecutor or trooper in the habit of intentionally or negligently throwing DUI cases by failing to respnd to discovery requests be removed, fired, or otherwise disciplined. Nothing can bring Mairi-Caitlin back; but drunk drivers are equal opportunity killers.
