A Preview Of McConnell’s “Kapitolpolizeitruppe”
South Carolinians got a sneak peek at what Senate President Glenn McConnell’s Kapitolpolizeitruppe (a.k.a. Capitol Police Force) might look like earlier this week – and it ain’t a pretty picture.
At least it’s not a pretty picture if you value your right to free speech and free expression – and if you don’t want those rights subjected to the whim of the notoriously mercurial, thin-skinned, vindictive hotheads who currently comprise the S.C. General Assembly.
Already, Sen. McConnell has set a dangerous precedent for how his Kapitolpolizeitruppe might abuse its authority.
McConnell, you’ll recall, came up with the ridiculous idea that lawmakers should have their own police force after Gov. Mark Sanford refused to waste any more money on extra State House security that the complex doesn’t need (and taxpayers can’t afford).
Well, two weeks ago, a creatively-attired African-American (this guy) began protesting McConnell on the grounds of the State House.
Apparently, this gentlemen also brought his act into the State House – where he was promptly kicked out after McConnell drew law enforcement’s attention to this statute of S.C. law:
SECTION 10-11-330. Unauthorized entry into capitol building; disorderly conduct, obstructing passage, demonstrating, and the like.
It shall be unlawful for any person or group of persons willfully and knowingly: (a) to enter or to remain within the capitol building unless such person is authorized by law or by rules of the House or Senate or of the State Budget and Control Board when such entry is done for the purpose of uttering loud, threatening and abusive language or to engage in any disorderly or disruptive conduct with the intent to impede, disrupt or disturb the orderly conduct of any session of the legislature or the orderly conduct within the building or of any hearing before or any deliberation of any committee or subcommittee of the legislature; (b) to obstruct or to impede passage within the capitol grounds or building; (c) to engage in any act of physical violence upon the capitol grounds or within the capitol building; or (d) to parade, demonstrate or picket within the capitol building.
Funny … that last provision sure seems to encompass any sort of “demonstration” that takes place inside the State House (including Gov. Mark Sanford’s famous charts and graphs).
And what constitutes picketing?
Is it wearing a sticker? Holding a sign? What about handing out “support the arts” paraphernalia?
And when it comes to “impeding passage,” doesn’t that statute encompass the disgustingly-prostrate rows of judicial candidates, lobbyists and other glad-handers that line the State House entrance ways looking to guffaw with their favorite lawmaker?
Try running that gauntlet and see how your “passage” went.
Anyway, what happened here has nothing to do with statutes – McConnell had this guy thrown out because he was carrying a sign that McConnell didn’t like.
An unfortunate byproduct of this unfortuante precedent? Longtime anti-abortion activist Steve Lefemine has been told now that he, too, is prohibited from bringing his signs into the State House.
Say what you want about Lefemine – or McConnell’s protester – but the fact remains in a free country they should be permitted to voice (or appropriately display) their beliefs in the lobbies of public buildings.
Obviously, there are limits to free speech, but in the case of these two individuals they were simply carrying signs – signs that in no way, shape or form impeded or endangered anyone.
Letting a lawmaker toss them arbitrarily for that is unacceptable.
Giving that lawmaker his own police force to control?
That’s downright insane.

I hope someone challenges this statue on First Amendment grounds. This law appears to violate a citizen’s right to peaceably assembly and protest for redress of grievances. McConnell can already use our tax dollars against us to fight a lawsuit; the last thing we need to give him is the power to arrest citizens as well.

I am a big free speech first amendment advocate, but despite the fact that this fella was an African American, the picture you have appears to have him in a Klan outfit – burning a cross on state house grounds may be fee speech as well – but it goes a little beyond the pale, and with this outfit on which includes a mask, I am frankly fine with the decision to get him off state house grounds. If this wacko would have shot someone, the only story run would have been “state house security drops the ball” and comments to the effect of “who the hell wouldn’t exepct this guy to have pulled a knife/gun et cetera”

I think that the last thing this state needs is another police department. Every city has one, some are just one guy. The state has all kinds, DHEC has the pharmacy cops, the Department of Public Safety has the trucker cops, the Forest Commission has the tree cops. There is an agency that is specifically designed to protect all state buildings and employees, the Bureau of Protective Services. If the legislature feels like they are the target of a thrid world religous extremist, then they should fund BPS approperiately. If they think that the Chief of BPS is not taking them seriously (like anyone can take the legislature seriously) then they should take that up with the Governor. Of course, all that depends on the legislature and governor acting like adults. Truely the impossible task.

I saw that guy at the state house last week. And he was bothering no one, except he did look like an idiot.
But I was shocked at how aggressive the capital police were to him. He was harmless…but they reminded me of some bad TV movie making fun of right-wing cops. One cop was really in the idiots face.
I was mad, and felt empathy with the idiot. McConnell thinks he is above the rest of us.
McConnell is a fool that has gone far on little ability. He is a thug in very cheap clothes.

Considering the elected elite are stealing our Social Security money, let’s all protest. There are not enough officiers to lock up the entire population of this state and in fact, things can turn on a dime. People should remember that.
The State of South Carolina is paying subsidies on fraudulent SSI accounts.
The elected elite are allowing this to continue….

Take it into its truest context. McConnell made sure the beat down happened to a black man dressed in a klan robe. Was he beating up a black man making fun of a symbol of his beloved south? Did one of the quinnies phone it in on their way back to clan central on gervais street?

FYI. The black gentleman was back at the State House Thursday with the same sign in tact. He was standing outside the Senate chamber, but this time was without the Klan regalia. Also, Lefemine’s signs of aborted fetuses were back. I sure the the little third-graders and their parents who were touring the State House appreciated that.

Mab, I’m no friend of abortion,(at least not in most circumstances) but there’s a time and place for everything. If I had a nine year old, I wouldn’t want that child subjected to pictures of that sort at that age, particularly when the purpose of the visit was to view history and architecture. And I’m intrigued by your use of the word “intrusive.” Usually it’s used by women who say that the federal gov’t. has no right to “intrude” on their right to chose.
