Public Enemy already told us we “can’t truss it,” and when it comes to the most important amendment in the Bill of Rights – the First Amendment – our motto is it’s better to be safe than sorry.
Fortunately, that’s U.S. Sen. Jim Demint’s motto as well.
By attaching a “Broadcaster Freedom Act” as an amendment to an upcoming D.C. Voting Rights bill, DeMint (R-SC) is looking to short-circuit a revival of the “Fairness Doctrine,” a CCCP-style intervention into the inner sanctum of the Fourth Estate that would force broadcast media outlets to provide “contrasting viewpoints” on political issues.
Eliminated during the Reagan era, the “Fairness Doctrine” was determined to be unconstitutional because it “restricts the journalistic freedom of broadcasters” and “inhibits the presentation of controversial issues of public importance to the detriment of the public and the degradation of the editorial prerogative of broadcast journalists.”
That language stems from a Federal Communications Commission ruling that has been upheld on multiple occasions by the courts, but there’s also the language of the First Amendment, which clearly states that Congress shall make no law “abridging the freedom of speech, or of the press.”
President Barack Obama has said he “won’t pursue” a reintroduction of the “Fairness Doctrine,” but he hasn’t yet assured the public he would veto such a bill were Congress to pass one – which is why DeMint is making his push to get Senators on the record for or against it.
“Do you support free speech or do you want to silence voices you disagree with?†DeMint says he will ask of his fellow Senators.
That’s a good question … and one every member of Congress should answer.

Please stop flogging this non-story. If Jim Demint wants to impress the mouth breathers that love him, fine. But do not legitimize the falsehood that there is a move to reinstitute the fairness doctrine.

We seem to recall putting a bee in your bonnet the last time we wrote on this.
If there is no such movement afoot, then Senators should have no problem voting in favor of DeMint’s amendment.

You girls just can’t stop yourselves. On Wed, this is what Obama’s spokesman had to say:
“President Obama opposes any move to bring back the so-called Fairness Doctrine.”
It’s not an issue. Demint is doing what all dumb politicians do – and Demint is perhaps the dumbest in all of Washington, no small accomplishment – he’s grand standing. And that’s the reason the Republican Party will stay in the political wilderness for a generation. You’re not serious people with serious ideas.

Non-story? The lady doth protest too much me-thinks!
Of course the Dems want the Fairness Doctrine. They will likely sneak in a stealth version within the next stimulus bill (wonder if the Dems will actually read it this time around)which will change broadcasting format. This way Mr. O. may publically proclaim his opposition to the Fairness Doctrine but sign a bill which institutes similar restrictions on free speach.

Sure glad Demint is spending time on a non issue such as this one, its not like he should be spending his time and energy worrying about education, unemployment, immigration, lack of industry, increase in violent crime…nahhh i feel much better knowing he is playing to his base on another non issue..next up..gay marriage..although they usually only pull that one out around election time..Bang up job Senator..bang up job!!
