Scarborough Decision Coming Soon
S.C. Representative Wallace Scarborough (R-Charleston) could decide as soon as tomorrow whether or not he will appeal a State Election Commission ruling to the S.C. House of Representatives.
If he does, hang onto your hats.
Scarborough, who was defeated on Nov. 4 by Democrat Anne Peterson-Hutto by a mere 221 votes (out of nearly 18,000 cast), is claiming that no fewer than 365 votes were improperly cast in the race.
His request for a new election was shot down by the Election Commission last week, although sources tell us Scarborough is confident of the case he can make to his fellow lawmakers, and is leaning toward making the appeal.
Initially, it was thought that lawmakers only remedy in this matter was to seat either Scarborough or Peterson-Hutto, however they could decide based on the evidence to void the election entirely, which would trigger a vacancy and a special election, the date of which would be set by the Speaker of the House.
Several lawmakers we’ve spoken with seem inclined to do that, although we’ve spoken to several Democrats obviously who are pushing to have the House seat their candidate.
Why isn’t any of this in front of the Supreme Court?
Well, according to Article III, Section 11 of the State Constitution, “each house shall judge of the election returns and qualifications of its own members.”
Accordingly, if the evidence is sufficient to show that results of this election are not valid, lawmakers would have the right to void the election.

I don’t know why he’s so obsessed about getting back his seat. You’d think he be looking forward to spending time with his “friend” now that they both have plenty of time on their hands. Take some ownership of your defeat, Wallace. You can’t run around having affairs, shoot at linemen doing their job and then expect to be re-elected.
