ALL THAT PANDERING COULD BE FOR NOTHING

FITSNews – June 8, 2008 – On the same day that S.C. Gov. Mark Sanford signed the “nation’s toughest” immigration reform bill into law, a federal judge in Oklahoma tossed out similar employer verification standards which were included in that state’s immigration reform bill, which proponents also referred to as the “nation’s toughest.”

From the AP:

U.S. District Judge Robin J. Cauthron issued a preliminary injunction prohibiting enforcement of provisions of the law that subject employers to penalties for failing to comply with a federal employee verification system.

The decision came on a lawsuit filed by the U.S. Chamber of Commerce, the Oklahoma Chamber and other business groups, who argued that the electronic verification system is voluntary under federal law and that employers should not be subjected to state penalties.

“Through harsh civil penalties, the Oklahoma law unfairly shifts the burden of immigration enforcement from government onto the backs of business,” Robin Conrad, executive vice president of the U.S. Chamber, said in statement.

The argument here is pretty simple … until the federal government fixes its immigration laws (and finds a way to enforce them), states are powerless to circumvent the process. Which means that all the petty political pandering that’s been going on here in South Carolina over the past six months was for nothing.

Well, except of course that the “immigration reform” issue did precisely what South Carolina politicians wanted it to do – it deflected attention from their abysmal record on every other issue during an election year.

Great job, SC! Doing the work that the Federal Government “just won’t do.” It’s time for every state to step up just as SC, AZ, OK, MO, GA and MS have. Simply enforce the law and illegals (those with any sense) will leave of their own accord when they realize they can no longer hold their illegal jobs and receive all the corncopia of government assisted benefits they had been accessing.

Why should even one American citizen suffer a crime of any sort at the hands of an illegal alien? (NOTE: Over 50,000 Americans have been killed by illegal aliens since 9/11 by either murder or drunk driving) Every single crime committed by an illegal alien is completely preventable by enforcement of our immigration laws.

Our country, America, suffers a crime every time an illegal alien takes their first step onto our soil. That is intolerable to me and the vast majority of the American people. The only legal, moral and viable solution to illegal immigration is ‘attrition through enforcement’. That’s accomplished by simply enforcing the law. It’s currently illegal to employ illegal aliens. It’s also against the law to provide some state and local services to illegal aliens. Imagine that, by enforcing the law, illegal aliens will be without jobs and their gravy train of benefits they are so adept at accessing. It would be exceedingly hard (impossible, really) to remain here without a viable source of income. They found their way here; they can find it back home. Its called self-deportation. And it works…just look at the droves of illegal aliens leaving Oklahoma, Georgia, Arizona and soon from MO, SC and MS..

Those that don’t self deport are ID’ed if they commit crimes and deported. No rocket science is needed to solve the illegal immigration problem. The issue is not complex nor impossible or extremely costly to deal with, as the illegal aliens, their huggers and advocates would like for you to believe. Simple commitment to enforcing laws we already have on the books will work.

The more we become a nation of illegal immigrants, the deeper we fall into anarchy.

Hardly any Democrats have endorsed the pending Federal SAVE ACT (H.R.4088), including a Lindsey Graham, who sided with Ted Kennedy to bring us a massive AMNESTY. Please ask them why? Because their leaders are threatening them with alienation, from campaign contribution resources. Remember we can stop illegal immigration with this bill enacted. The next president is going to sign a massive AMNESTY. Take into account the SAVE ACT, would strengthen state immigration laws, like the latest enacted in South Carolina. The SAVE ACT has ‘zero tolerance’ for parasite employers or illegal immigrants and is all encompassing this nation.

Only the American people can stop it?

The 9th District court and jurisdictions have an allergic reaction that benefits the majority of the American people. There is revolution in the air, when judges who do not play by the rules of our Constitution. These judges are sworn to uphold the laws of the the United States to protect the people from both enemies (foreign & domestic). When you see the state of affairs in California, you know these men in black gowns are pandering to the millions of illegal aliens squatting there.
Our Country’s Constitution, states are bound under the Supremacy Clause to enforce federal immigration laws. The statutory law of the United States is part of state law just as if it were written into state statute. This is why I am so disappointed that many of our cities, activist liberal judges and police administrators have made the political decision to not enforce the law. As you know, there is no legal barrier hindering local police from inquiring about a person’s immigration status and then acting upon the information they gather. This was codified in a 2005, 9 – 0 landmark decision, by the U.S. Supreme Court in Muehler vs. Mena.

So Great work Sheriff Joe! The illegal masses are leaving Arizona in droves and heading for greener pastures. Probably for California that is slowly going bankrupt, under the immense pressure to support any illegal alien who walks across the state line by the special interest lobby. Today! Now! Is to push your reluctant Democrat to endorse the federal SAVE ACT (H.R.4088) because leading party members know that the new president will sign a new AMNESTY (2022243121)

So many crimes are happening across America, that usually do not warrant any national press report. The question is, has this been going on for decades? That only because we have the Internet, instant communication that everybody knows almost immediately? Or is it because the masses of illegal people entering this nation, without being screened has brought with them a third world mentality? If it wasn’t for Independent Journalists like Lou Dobbs of CNN or O’Reilly from FOX, Glenn Beck, as the population of activists Americans would forever remain in the dark. Pro-immigrant zealots don’t like it, because the average citizen or legal resident has a say in this explosive issue. Regular citizens have become the first line of defense of corrupt politicians and the special interest lobby, that remain in collusion with far-left (9th district court) judges and extremist groups which border on tyranny.

Americans do not have the financial backing of corporate farms, Foundations, business CARTELS of funds extracted from taxpayers without their knowledge. Funding anti-sovereignty, extremist entities like La Raza (the Race), Army of National Liberation and Mexicanos Sin Fronteras (Mexicans Without Borders, just to name two.

Those who steal across our perforated fence, includes the criminal element that think they above above US law. Each day citizens are slain on the roads of America, by drunk illegal drivers. This is far from isolated case, because these accident reports are not necessary revealed by the biased press. Pedestrians have become ‘road kill’ daily, especially when the victims are innocent children. Do not expect to read about this carnage in the New York Times, the Los Angeles Times. You need to dig deeper in rural newspapers or the e-media on the Internet, to find the unsuppressed facts.

Then we have the violent street gangs protected by ‘Sanctuary cities’ like Los Angeles. The unsuppressed news reports will tell you about the child pedophiles, female assaults, murders, robbers and Social security theft that do not get wide press. Thousands of families are left to pick up the pieces of their shattered lives. The pro-immigrant zealots use the same mantra, that citizens and legal residents commit these crimes also…? But why when we have our own inmate crowding our prisons, should we need to support illegal foreign nationals criminals. Today we cannot even deport them and breathe a sigh of relief, because it seems like days before the return via the porous fence to violate our penal laws.

It seems like our ‘Rule of Laws’ are violated everyday, because the business empire demands cheap labor. Our corrupt politicians play games with American lives because they refuse to enforce immigration laws. All encompassing is the Federal SAVE ACT(H.R.4088) that Speaker Nancy Pelosi is trying to derail along with the original two-tier border fence.We need ‘zero tolerance’ enforcement, that will give maximum arrest and detainment of predator employers of illegal immigrants. South Carolina just joined other states with new employer sanction law,but needs the added teeth of the SAVE ACT, which will strengthen its enforcement power.

A new AMNESTY is in the works from Senator Obama, McCain which will flood America with even more of poor, illiterate foreign labor. McCain is a ‘dark horse’ because his original stand with pro-illegal immigrant groups. How can we trust either McCain to seal our border, when he is a hard-core globalist? Most globalists are open border, free market zealots, whose agenda is the free movement of cheap labor in the North American Continent. NUMBERSUSA. I live in AZ where our laws are a great success getting the illegals out. They are flooding back into mexico and into neighboring states, forcing our business to offer fair wages and our neighbors to rethink their liberal shelter laws as they get more than they bargained for. The feds are doing their part too – from actually enforcing the laws on the books to building the fence, we see more of it go up every day. To heck with what the liberals call “comprehensive immigration reform” I say we allow the states to teal with the issue and have the feds continue their line as well. I am no republican, I vote along with the dems on nearly every other issue, save firearms, but when you start being treated like a second class citizen because you don’t speak spanish and you see people flying their native flags and acting entirely like they need not assimilate you start feeling very nationalist. I am not a racist I have many friends who were natives of, or whose ancestry comes from, mexico and other nations but I feel it is a matter of respect to the nation you call home, whose freedoms you take for granted and whose military works to keep you free to honor that by speaking the language native to that nation and flying here flag.

The most racist and shocking part of this new “law” is that they set up a phone line to “report” undocumented immigrants. So if some redneck thinks someone is illegal just because of the color of their skin they can report it

The Common Claim that Illegal Immigration is a Federal Dilemma:

An “urban legend” that has unfortunately been widely disseminated holds that states and local jurisdictions cannot tackle the problem of illegal immigration, since it is solely under federal control. Legislators and members of the public cling to this legend when confronted with the enormous consequences of unchecked illegal immigration. This allegation is entirely false.

Undeniably, the United States Congress has ultimate and prevailing authority over immigration. U.S. Const., Art. 1, §8, Cl. 4. Furthermore, it is accurate that any state legislation or local ordinance that conflicts with or contradicts federal statutes is preempted by the Supremacy Clause. U.S. Const., Art IV, Cl. 2. However, the Immigration Reform and Control Act (IRCA), enacted by Congress in 1986, expressly delineates aspects of illegal immigration that can be targeted. Pursuant to 8 U.S.C. §1324a(h)(2), states and localities are not preempted from enforcing “licensing or other similar laws” targeting the rampant illegal immigration crisis.
IRLI has been advocating that states and local jurisdictions are not preempted in the above-mentioned areas and this reasoning was affirmed by two federal judges discussed above (Arizona and Missouri federal victories). These findings should further embolden states and local jurisdictions that they have viable options to target the illegal immigration problem since the federal government is choosing not to enforce its law. States and localities can and should take matters into their own hands.

That’s a good plan! Just tell the states to do nothing! Then you can share all of the illegals that are leaving Arizona, Oklahoma and Georgia. The enablers can learn about drop houses, home invasion robberies, 8 hour waits in the ER and property taxes skyrocketing to provide services to illegal aliens who have no intention of abiding by the law or learning English. You too can have your trade wages locked in at 1985 rates. Face the fact, there are NO after school, summer, or entry level jobs for your teens because the illegals have taken them as careers for $8.00 per hour because they will live 20 to a 3 bedroom house and sponge off the liberal welfare and public benefits system that was designed for citizens in need. Be prepared for the illegals leaving states conducting immigration enforcement to find their way to your state so they can conduct their scams. Good luck with that “nothing will really work” attitude. If you wait for the feds, you’ll all be overrun, taxed to death, poor and a number of you dead.

Congressman Joe Baca (D-CA) and the Hispanic Caucus are already trying to pass a bill right now in the U.S. House to give out “5 Year Amnesty Visas” to all of the illegals here (and I’m sure there is a loophole in it somewhere that includes dozens of their closest relatives). The pro-illegal politicians who won’t enforce the federal laws are doing this to stop states from enacting their own enforcement laws. Oh, they aren’t telling you about that? What a suprise! Let me guess, they aren’t telling you that they stripped the $1.4 Billion dollar funding from the Secure Fence Act of 2006 and Bush made a back room deal to GIVE the 1.4 BILLION DOLLARS as “foreign aid” to Mexico with NO conditions? Senator Kay Bailey Hutchison (R-TX) slipped in an amendment to the omnibus spending bill in Dec. 2007 that gave DHS Secretary Chertoff the power NOT TO BUILD any part of the fence anywhere he didn’t want to in case funding was ever restored. So we go from a law passed by Congress in 2006 which mandated a double layer 700-mile fence, to no double layer fence to no fence at all anywhere the DHS secretary declares.

And we still have people saying immigration is a federal issue and we must wait for the feds to act? The only thing the feds will ever do is to try another massive amnesty plan to legalize all the illegals to get them off the hook for creating the massive problems we face from 20 million plus illegal aliens. Aren’t you tired of being deceived and lied to, America? Aren’t you tired of politicians crafting legislation that puts the welfare of illegal aliens ahead of citizens and legal residents of America?

Immigration is a Federal problem, It is unconstitutional for states to take action on this.

We need a comprehensive immigration reform that will fix our immigration system and secure our borders.

You cannot deport 12 million people, it would be devastating for the agricultural sector and unfair.

A recent University of South Carolina study concluded that the effects of the Latino presence in the state are mixed, with wage depression occurring only in some sectors. It also concluded that the still small (but growing) Latino presence in South Carolina has led to small education and health care costs. This study also noted that despite an increasing Latino presence in health care facilities, Latinos do not appear to be overwhelming the system. For example, in 2005 Latinos made up only 1.6 percent of all hospital discharges (inpatient, outpatient or emergency room visits).

The study also pointed out that federal funding has provided some of the resources needed by the South Carolina public education system to provide services to Latinos. Furthermore, schools are also community centers that bring together cultural and linguistic diversity that will be needed by students who will compete in an increasingly globalized world.

A recent Urban Institute study concluded that Mexicans (the major Latino immigrant group in South Carolina) were the only group for which unlawful entry was the dominant offense. Moreover, businesses that hire undocumented workers take out of their pay worker’s compensation and Social Security deductions, as well as insurance and federal income tax.

Until we have comprehensive federal immigration reform, I hope that the discussion of the impact of undocumented workers can be done without “scapegoating” Latinos or any other group.

I guess people have never heard of the Supremacy Clause:

This Constitution, and the laws of the United States which shall be made in pursuance thereof; and all treaties made, or which shall be made, under the authority of the United States, shall be the supreme law of the land; and the judges in every state shall be bound thereby, anything in the Constitution or laws of any State to the contrary notwithstanding.

What part of FEDERAL do you people not understand?

You know as well as I do that the State GOP does this to pander to the least common denominator. None of this will matter when Immigration Reform is passed in the next 2 years. What happened to the presidential candidates that were “tough” on immigration? Oh thats right, they dropped out of the race! Americans are not xenophobes like all of you ALIPAC’ers. The sooner you realize this the better off you’ll be.

It’s great how the anti’s think the same government they can’t trust to ‘enforce’ immigration laws is going to have some magical ability to get a database up and running correctly. I’m sure these guys don’t care if a few innocents get put in the bunch because it’s better to arrest everyone – you know you’ll get at least a few guilty ones.

Why look at the real issue when you can just pass laws and point fingers? These ‘tough’ laws might give the anti’s warm fuzzy feelings, but they will add up to nothing but disaster.

The same results that Alex has mentioned about South Carolina have been determined to be accurate nationwide, as well. Zeezil,, apparently, does not understand our Constitution nor does he agree with recent Supreme Court decisions. Lots of fear, too. Never heard that I might die if nothing was done. Then he adds the lies. No, Zeezil, immigrants are not eligible for public benefits. And they are learning English.. But people like Zeezil are not known for letting the facts get in the way. That is a nice way of saying he’s full of crap.

With South Carolina’s history of racial hatred, do we really want to go there again? South Carolina is a state in need of racial healing. These new laws simply feed on the ignorance of bottom feeders looking for a way to legitimitize their own hate. If someone on the state level truly wanted to improve the lot of working people, they would raise the state minimum wage and strengthen rights of working people at their places of employment. Or is that too radical for South Carolina?

One day politicians are going to wake up and realize that pandering on the immigration issue is a really, really bad idea. Not only is it divisive, but it will lose them votes in the long run, as they turn away progressive voters and an up-and-coming generation of latino and minority voters who are changing the face of our nation.

We need to focus on initiatives that bring us together as a people, not ones that are overly punative and fail to address the complex problems with our current immigration system.

Immigration law is indeed a federal matter. The problem is not that the feds are “refusing to enforce the law,” it’s that the law is a mare’s nest. Fibber McGee and Kafka could have invented it. Patchworking local “solutions” onto this mess will make it worse, not better. It needs to get cleaned up and made consistent, just, and reasonable. Right now it is none of these things.
