New Solicitor In Senator’s DUI Trial

SPARTANBURG PROSECUTOR TO MANAGE RANDY SCOTT DRUNK DRIVING PROCEEDINGS

FITSNews – May 6, 2008 – The DUI trial of Lowcountry State Sen. Randy Scott will be managed by a Spartanburg, S.C. prosecutor – not the solicitor assigned to his district – a judge ruled today.

Trey Gowdy, the 7th Circuit solicitor will prosecute the case after 1st Circuit solicitor David Pascoe recused himself. The decision ostensibly clears the way for Scott to receive a “fair trial.”

Scott’s DUI arrest – news of which was broken exclusively here on FITSNews – also unexpectedly morphed into a case study on the First Amendment over the weekend.

Specifically, the Senator’s attorneys attempted to block the publication of several incriminating jailhouse tapes which included Scott cursing extensively and instructing a magistrate to “get off his lazy ass” and release him from jail.

FITSNews was pressured to remove the tapes from our website by Scott’s attorneys, although that was before they recognized that our lawyers drink the blood of their young.

UPDATE - Initial reports were that the trial itself was set to be moved to Spartanburg, but apparently a venue hasn’t been set yet.

It was all over the Low Country and Midlands for hours before you stuck it on your porn site (sorry, “political bog”) and claimed a scoop of kitty litter! Give the man a chance to defend himself. Not everyone pleads guilty. Some have good lawyers and explanations. Remember, sic(k) willie, innocent until proven guilty! Unless you confess to CDV.

If I was advising Sen. Scott -here is what I would have him do now. Have a news conference very soon without his lawyers present. He will have his wife there along with the “other woman” and will answer any and all questions from the press .

This would show he has absolutely nothing to hide and wants the people who elected him to know the whole truth.

This is a much better approach than threatening and intimidating the media to withhold public information from the public.

Great! Another totalitarian government in the making! Why do we claim to have a democracy when the one thing that allows one to function ,freedom of speech, is being slowly strangled. Once more a miniscle piece of information is censored. Do we want to become like another Kim Jong Il Regime? It’s time we as a nation take the fight to our real enemies, at home.

I think that Sic Willie is not at fault. I am very sure a politically informed senator would know that calling to or from any government building would resolve in being recorded. He also should always be concerned about his image and quite frankly a man of his age should know his drinking limit!

We are torn between sides. We believe that yes, it is freedom of speech and everyone has that personal right. On the other hand it was wrong to expose that man’s information without consent or confirmation. We both believe that if someone does something bad it should be exposed! We believe Sic Willie did not break the law, but at the same time he took advantage of Sen.Scott’s drunkeness. That is why we feel torn between both sides in this situation.

Sic Willie:
We are glad that you put those sound clips up and available to the public so that the people can have access to info about the person they may be or not be voting for, or making decisions for their state. Besides, he was told he was being recorded. If he didn’t want the tapes to be heard then he shouldn’t have said those things.

I do not think Sic Willie broke the law b/c he has the right to free speech and is just trying to inform everyone in SC the type of Senators they are voting for. Besides, if the Senator knew he was being recorded, why is he getting upset? He shouldn’t have done what he did in the first place.

I think Sic Willie did not violate the Doctrine of Prior Restraint b/c he was never explicitly told about the Judges orders- Do to the facts spelled out in his letter to Scott’s attorney, Sic Willie did not break the law!

This whole ordeal is a big joke! People should grow up and not break the law. If someone gets arrested for a DUI they should be put in jail and face all of the consequences. This man has no right to try and get his drunk driving dialing tapes out of the public view. The people at FitsNews have every right in the world to have the audio tapes on their website!

No Sic Willie did not break the law by posting the audio tapes b/c everyone has the right to know what really happened. And freedom of press is supported by the 1st amendment whcih allows Will to post the recordings of Senator Scott on his Blog.

I do not think that Sic Willie broke the law. As stated, the judge did not tell him directily and he and no knowledge of the restraint prior to Mr.Scott’s attourney’s e-mail. i think that this whole scandal is just another case of someone important trying to spin the law into their favor. Sic Willie was not out of contex in posting the audio on the internet.
The way i see it, sic willie was meerely exposing Mr.Scott as the drunkard that he is/was. When Mr.Scott found out about this posting, he threw a tantrum just like hitler did and he was able to get his way.
my point is that i laud sic willie for exposing the truth and educating the public.
keep breaking the law!!

People, sic(k) willie is a fraud. The only reason you think he had this story first is because you missed it in the mainstream media.

Posting those tapes was a “National Inquirer” moment for him, which is what willie lives for these days. That’s about all he lives for, scandal.

But, back to current events. Remember, innocent until proven guilty.

Except for CDV cases where the defendant pleads guilty.
